QUESTION: What kind of contract forms should be used for ADB TA financed contract for procurement of goods awarded under the direct purchase method? Are they the same forms as in sections VII, VIII and IX of SBD? If not, where can I obtain the contract forms already used for such cases?

ANSWER: Direct purchase method is no longer allowed in the revised Procurement Guidelines. Instead, EAs may use Shopping or Direct Contracting as specified in paras. 3.5 and 3.6 of the revised Procurement Guidelines. There is no standard contract form for Shopping or Direct Contracting. The contract forms in SBDs may be used in appropriate situations, such as in situation described in 3.6 (a) of the revised Procurement Guidelines, and with necessary modifications. For procurement of small off-the-shelf items costing less than $10,000, a confirmed Purchase Order will be sufficient.
